Limits rising, duties ascending: is the Court of Justice changing the legal shape of Union citizenship?

This seminar will look at the intensifying rise of the limits and conditions that are being placed on EU rights in current Court of Justice case law on Union citizenship. It will also reflect on the structural implications of the case law shift from ­rights-opening to rights-narrowing in terms of how the Court of Justice does – but also should – respond to evolving political and public preferences on free movement. In the deeply interlinked EU governance system, who actually “owns” EU citizenship, from a constitutional perspective? Relatedly, what happens to the substance of rights developed judicially at the constitutional level when the same judiciary makes adjudicative choices that seem subsequently to prioritise different or at least altered constitutional objectives? The paper seeks to conceptualise limits and conditions in a way that preserves the integrity of the constitutional rights on which they are placed and thus, in turn, preserves the integrity of the Court of Justice as a constitutional institution.
